It is a fact that not all marriages end with happy endings. Some couples find out that it is hard to live with someone who you do not love and care for. Other couples start their marriage full of love, but after five or ten years, they fall out of love for each other. Sad endings in marriages could be the result of various circumstances that might happen along the progression of the relationship. If a couple has already decided on getting separated, then they need a divorce. But getting a divorce is never easy. You need to go through some legal processes to end the relationship. It would be hard to get a divorce on your own, and you will definitely need a lawyer if you have children who are minors and have several joint properties.

In the process of divorce, a husband and a wife could have different agendas and own interests. In most cases, a couple filing for a divorce needs a lawyer to represent and defend their own interest in the court. But if you and your other half do not have children and properties or stocks to divide, then it would be easy having a divorce even without the help of a lawyer. Both parties would just have to come to an agreement which compensates the demands of both parties. Not all couples are advised to file for a divorce without a lawyer because there are some conditions that must be met in order to do away with the need of a lawyer.

The do-it-yourself-process of divorce is also termed as the Pro Se divorce. To be able to use this process, there are certain conditions that both parties must meet. Both parties must not question any demands from the other party, and they both must agree to the terms set by each other. If the couple has children, they should be of legal age and must not be connected with the case. When filing for a Pro Se divorce, any charges to the other party like debts, physical and mental abuse, or other criminal acts must not be present. Both parties should also be financially stable after the divorce so that there will be no discussion about financial supports to the other party like alimony. If the couple has a common asset or a set of properties, they must both agree to the distribution of these assets. If the couple does not agree on a detail about the property split, then they should ask a lawyer to assist them so that they won’t not need to go through a Pro Se divorce.

Before applying for a divorce without a lawyer, make sure that all the conditions while undergoing a Pro Se divorce is met. You must review and understand the law in your area which is always an area of concern with divorce. Prepare all the required documents that would support your claim. You can obtain divorce forms at the local courthouse in your area. The good thing about having a divorce in this manner is that you can save a lot of money. The negative consequence here is that either party cannot seek any legal help from a lawyer since both chose to represent himself or herself in front of the judge. If you want your divorce application to be approved immediately, bring all the necessary requirements in court. You can also ask some legal advice from law students from legal clinic when it comes to preparing your documents before facing the courthouse.
